Why You Need to File a Workers' Compensation Claim

When a person is injured at work, the workers’ compensation insurance company may pay you for your medical treatment and/or your lost wages.  Having this paid, many injured workers’ think there is nothing else they need to do in order to protect their legal rights.  Unfortunately, such an assumption frequently leads to an injured worker losing their rights.

Under Maryland Workers’ Compensation law an injured worker who sustains a compensable injury is entitled to three basic benefits.  These include: 1) lifetime medical treatment, 2) payment for lost time from work, and 3) the right to receive an award of money for any permanent injury or settlement of their claim.

In order to receive all of the above rights (and more) an injured worker must file an employees claim with the Maryland Workers’ Compensation Commission.  If this claim is not filed within two (2) years of an accident or occupational disease, then an injured worker can (and in most instances will) lose the right to any of the above-mentioned benefits.  The filing of the employees’ claim and the information provided in the claim form, or the information provided directly to the employer’s insurance company, will be used to determine whether the claim is accepted by the insurance company. This is why it is very important to contact us as soon as possible after an accident at work and  prior to filing any claim for workers’ compensation benefits, so that we may provide you with legal advice as to how you should proceed with your claim.

Equally important is that you will not be charged any type of fee unless we are successful in obtaining benefits for you. Furthermore, any attorney fee in a workers’ compensation claim is not paid out of your pocket, but instead is paid from the money you receive from the insurance company.  The fees are governed by law and set by the Workers’ Compensation Commission.
