Personal injury law is designed to protect you if you or your property are injured or harmed because of someone else's negligence or failure to act. A personal injury lawsuit is a civil, not a criminal matter, and the wrongdoer compensates the victim with money. If you have been injured by someone else's negligence it is very important you speak to a qualified personal injury lawyer. There is a time limit on the amount time you are able to receive compensation. Waiting too long could affect your ability to make a claim.

What is Personal Injury?
There are three different kinds of personal injury -- or tort -- actions: negligence, intentional torts, and strict liability. But almost every personal injury lawsuit shares the same fundamental question. Was the defendant responsible for the damages you sustained and, if so, what is the nature and extent of your injuries? Even when liability is established, parties to a lawsuit often argue over the proper amount of damages. Some types of damages, like medical bills or lost wages, are relatively easy to calculate. But other kinds of damages, like pain and suffering or a person's expected future earnings are frequently the subject of discussion. Your injury does not need to be physical to bring a lawsuit. Many suits are based on a variety of nonphysical loses and harms to reputation or psyche.

Slip and fall accidents are more common with senior citizens, although anyone can suffer such an incident. About 60% of falls are due to slick surfaces, an object on the surface that will cause a person to trip, or even a flaw in the way the surface was designed. If a person falls on another person’s property and wants to seek compensation, their law team must prove the owner of the property caused the dangerous spot or knew of it and didn't’t repair it. Often times property owners may be aware of an unsafe condition but choose simply to ignore it. Typically owners will ignore a safety risk because it costs money to fix the issue. When an innocent person gets hurt because the owner did not have a safe environment - that is a personal injury claim. This type of serious injury can be more common than most may think. It is also more serious than most may think. Slip and fall does not mean simply if someone falls down they can collect compensation. Slip and fall cases typically involve a large amount of negligence by a property owner or business to simply not fix a safety issue that should have been fixed, thereby causing injury or even death to the victim.

Truck accidents can be particularly dangerous because of the large size of the truck, compared to passenger vehicles. Truck drivers are often overworked, drive long hours, and drive drowsy, giving way to a lack of attention to the road, and perhaps driving recklessly. Some even drive under the influence of drugs or alcohol. Trucks are so large, they have poor visibility all around, and other drivers on the road should use caution when driving near a truck. Truck drivers should understand they have an extra responsibility to drive with care than drivers of passenger vehicles because of the large size of the truck and trailer. Truck drivers have strict regulations as to their driving time, and should be held responsible when they are in violation of those restrictions.

About 60% of falls are due to slick surfaces, an object on the surface that will cause a person to trip, or even a flaw in the way the surface was designed. Sometimes it may be hard to determine who is at fault, if the property is rented to another party.

Dog bites can cause serious injury. Owners should know they can be held legally responsible for the dog bite if the dog has a history of aggression.

- Auto Accidents
Auto accidents are extremely common in Maryland and all of the US. Auto accidents are also the most common cause of Personal Injury. Everyday negligent drivers get behind the wheel and everyday accidents are made and innocent victims are injured. Lets take a moment to talk about negligence. What is it? Negligence does not just mean 'Oops I wasn't paying attention'. Negligence can also mean the driver was under the influence of drugs or alcohol. In Maryland negligence drivers may only get a traffic violation, vehicular manslaughter is not required. However prosecutors are fighting for a mandatory vehicular manslaughter charge. Anytime charges are fighting to be increased its a solid sign that the consequences are horrific. In this case a negligent driver could cause another persons death.

- Truck Accidents
Truck accidents are much much worse than car accidents. In a car accident the results are not always that bad. Could be a fender bender or a minor injury, however with truck accidents there is a much higher percentage of deadly results. Typically in truck accidents in the injured victims are not the truck accident driver them self. Truck accidents can occur for many reasons such as weather conditions or other unsafe driver conditions. Truck accidents can also occur if the driver is working over the allowed time, this is not uncommon. Truck drivers are forced to work set hour shifts however if they choose to break the law they may drive longer. The longer a truck driver drivers the higher the risk for an accident. Special attention and caution must be used not only for the truck driver but for car drivers.
Should I deal with the insurance company myself?
Not all personal injury cases are settled in court. In fact only a small percentages of injury cases are taken that far. Typically your personal injury lawyer will negotiate on your behalf with the insurance companies. When you are injured in an accident its best to immediately call a personal injury lawyer and have them directly speak with the insurance companies. Why? Insurance companies are very smart and they have one goal in mind - to keep as much (or all) of their money as possible. Personal injury lawyers know these tactics and tricks and know how to best fight against them. Insurance companies are not worried if your settlement is enough to cover all your medical expenses. Or if you have enough money left over to handle your lost wages. Experienced personal injury lawyers know your situation. Our firm handles personal injury cases on a daily basis and understands the pain and frustration. In most cases we are able to successfully negotiate a settlement with the insurance companies, thereby getting money in your pocket as fast as possible. If negation is not possible then we will take your case to trial. In a trial the settlement amount is decided by a jury. The process becomes slightly more involved at this point. You can see that a personal injury case is not always as simple as calling the insurance company and saying 'Hey I'm hurt - pay me please'. Unfortunately calling them directly may not be in your best interest. So what's next? Contact our firm for a free consultation with a personal injury lawyer.

It could take days or weeks for symptoms to appear. Victims of brain injuries often suffer long term disability. Brain injuries affect physical, motor, and cognitive skills. They can cause behavioral or psychological problems. Brain injury occurs when an auto accident traumatizes the brain causing damage or impairment to brain functions. Fractures, bruises and nerve damage are all common and related to brain injury. Whiplash is very common in rear end accidents, where as brain injury is more common in side impact accidents. Spinal cord injury can be the result of bruising, laceration, pressure, or other types of damage to the spinal cord. Parts of the body may lose sensation and victims may become paralyzed to a degree. When the lower parts of the body and abdomen are affected, its called paraplegia. When the whole body from the neck down is affected, its called quadriplegia. Often those who suffer paralysis will suffer other health conditions and difficulties due to the condition. Paralysis can be permanent or temporary depending on the severity of the injury to the spinal chord.
Back Injuries

Whiplash
Of all the types of injuries that can happen from an auto accident, whiplash is by far the most common. Whiplash accounts for more than one million back injuries from auto accidents every year. Whiplash can also lead to long-term disability in some cases. Whiplash typically occurs when the victim is not in motion or is driving very slow and is then hit in the rear by another driver. The victims head is then forced forward and then backwards causing damage to the joints, muscles and nerves of the neck. Symptoms of whiplash can include muscle pain and spasms in the head or neck.
