Chapter 7 Bankruptcy

The purpose of a Chapter 7 bankruptcy is to have your debts forgiven by the Bankruptcy Court. The court sends your creditors a "discharge" order, which forever prohibits them from collecting the debts from you. Most types of debt can be discharged, including credit cards, medical bills, and unsecured loans. Some types of taxes, most student loans, fraudulent debts, and child support cannot be discharged.

To qualify for Chapter 7, you must not have filed and completed a Chapter 7 case within the last six years. You also must not have the financial ability to pay half of your debt though a Chapter 13 Plan over three years. If you have a lot of property, it is possible for the court to take some of it for your creditors. However, most people don't lose any of their property in bankruptcy.
